1. Provider / Contract Partner

PH Shine is the name of an online shop operated as a sole proprietorship by:

PH Shine is not a registered company name, but a shop and brand name.

2. Scope

These Terms of Service apply to all orders and use of the online store PHShine (phshine.com).
By using the Services or placing an order, you agree to these Terms.

A consumer is any natural person acting for purposes that are predominantly outside their trade or profession.

3. Products & Services

PH Shine offers:

Digital products (eBooks / PDFs) delivered by instant download.
Print-on-demand merchandise, produced and shipped individually after order placement by a fulfillment partner.

Product descriptions shown on the product pages are decisive.

4. Contract Conclusion

Products are placed in the cart.
Customer enters required data and completes checkout.
By clicking “Buy now” / “Place order”, the customer submits a binding offer.
The contract is concluded only when we confirm the order by email.

We reserve the right to refuse orders, in particular in cases of suspected abuse, fraud, or technical errors.

5. Prices & Payment

All prices are shown in the applicable market currency.
Taxes, shipping costs, customs duties, or import fees may apply depending on destination and are shown at checkout where applicable.

Payment is due immediately.
If payment fails, access to digital content may be suspended.

6. Delivery

6.1 Digital Products

Digital products are delivered immediately after successful payment via download link.

The customer is responsible for ensuring technical compatibility (PDF reader, device).

6.2 Print-on-Demand Merchandise

Merchandise is produced on demand.
Delivery times are estimates only and not guaranteed.

Risk of loss passes to the customer upon handover to the carrier.

6.3 Fulfillment by Third Parties & Data Sharing

For the production and delivery of print-on-demand merchandise, PH Shine uses external fulfillment partners, in particular Gelato AS or affiliated entities (“Fulfillment Partners”).

For the sole purpose of fulfilling the order, the following data may be transmitted to the Fulfillment Partner to the extent strictly necessary:

Name
Shipping address
Order details (product type, size, color, quantity)
Email address (only if required for delivery notifications)

The Fulfillment Partner acts as an independent processor and uses the data exclusively for production, shipping, and handling of the order.
No use for marketing or unrelated purposes takes place.

By placing an order for physical products, the customer expressly agrees to this data transfer insofar as it is required for contract performance.

7. Right of Withdrawal (Widerruf)

Statutory consumer withdrawal rights apply only where legally required.

7.1 Digital Content

For digital content not supplied on a physical medium, the right of withdrawal expires once delivery begins, provided that:

the customer expressly agrees to immediate delivery, and
acknowledges the loss of the withdrawal right.

This consent is requested during checkout.

7.2 Print-on-Demand Goods

Goods produced individually on demand are excluded from withdrawal where legally permitted, especially where goods are clearly personalized or made to order.

8. License for Digital Products

Digital products are licensed for personal use only.

You may not:

share, resell, upload, or distribute files
make content available to third parties
use content for commercial or public purposes

Violations may result in access termination and legal action.

9. Returns & Refunds

Returns and refunds are governed exclusively by our Refund Policy.
No goodwill refunds are granted beyond statutory obligations.

10. Liability

We are liable without limitation for intent and gross negligence.

For slight negligence, liability is limited to foreseeable damages typical for the contract and only for essential contractual obligations.

We are not liable for:

platform outages
shipping delays
misuse of digital products
circumstances beyond our control

Mandatory statutory liability remains unaffected.

11. Intellectual Property

All content, trademarks, designs, texts, and materials are owned by PH Shine or its licensors.
Unauthorized use is prohibited.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Mandatory consumer protection laws of the customer’s country remain unaffected.
